EULA (End User Licence Agreement) (also named ‘Terms’) apply to ‘User’ access and use of this website and other website hosts where Casian Anton via and as Revi Project 88 has content.

By accessing Revi Project 88 website and website hosts and using any of its content ‘User’ agree to these Terms. If ‘User’ does not agree to these Terms, including the mandatory arbitration provision, ‘User’ must not access or use Revi Project 88 content.

‘User’ must read these Terms carefully to understand them before using Revi Project 88 content.

Revi Project 88 may amend these Terms from time to time. Any changes to these Terms will be posted on this page and, where appropriate, notified ‘User’ via social media pages when an update is available. ‘User’ can check frequently to see any updates or changes made to these Terms.

Revi Project 88 is registered with Trade Mark Registry UK (effective as of the date August 20, 2022 and has been entered in the register on November 11, 2022).

I. DESCRIPTION OF CONTENT

Revi Project 88 is the name used to represent the fiction and non-fiction digital and printed content (ebook, paperback, hardcover, apps, audio, video) created and operated by Casian Anton.

Revi Project 88 is dedicated to furthering knowledge and advancing the understanding of various topics in the fields of Social Science (International Relations as a specific area of study; the study of interdisciplinary methodology, world state (or world government), structures of explanation, mass-media & propaganda) & Humanities (the study of the human condition as autobiography and fiction content). All the activities within this project is to guide, exchange, sustain and share unique and original ideas that can help people to understand the world.

To achieve this purpose, Revi Project 88 will: 

• produce and disseminate original research: the study of interdisciplinary methodology, world state (or world government), structures of explanation and mass-media & propaganda;
• writing stories: autobiography and fiction about the human condition;
• create and publish digital apps with fiction and non-fiction content;
• publish the results on digital stores in the format of ebooks, textbooks (paperback and hardcover), audio, video and apps.

The results (fiction and non-fiction) will be available on different websites and online stores (such as Amazon, Google Play Books, Google Play Store, Kobo, Smashwords, Apple Books, Barnes and Noble, Gumroad, Tolino (as media channel) and other websites).

By using Revi Project 88 content the ‘User’ understand and agree with the following terms.

Due to Privacy Policy and EULA of the website hosts the content will be available using real name Casian Anton (author and seller) or Revi Project 88 (author and seller), or a combination.

II. ELIGIBILITY

‘User’ must be at least 13 years of age to access Revi Project 88 content. If ‘User’ is under 18 years of age (or the age of legal majority where ‘User’ live), ‘User’ may only access Revi Project 88 content under the supervision of a parent or legal guardian who agrees to be bound by these Terms. If ‘User’ is a parent or legal guardian of an ‘User’ under the age of 18 (or the age of legal majority), ‘User’ agree to be fully responsible for the acts or omissions of such ‘User’ in connection with Revi Project 88 content. If ‘User’ is accessing or using Revi Project 88 content on behalf of another person or entity, the ‘User’ is responsible to accept or reject these Terms on that person or entity’s behalf.

III. REVI PROJECT 88 RIGHTS AND RESPONSIBILITIES

Casian Anton owns and operate all the content under the name Revi Project 88. Revi Project 88 will use reasonable endeavours to keep the the content operational, allowing for appropriate maintenance and updates and acknowledging that a certain amount of unscheduled time is needed in order to improve its content and to reply to ‘User’ requests (at least 30 days to reply to ‘User’ requests). Revi Project 88 offer no other warranty in respect of the content, and all warranties which would otherwise be implied into these Terms by operation of law are excluded to the fullest extent permitted.

Revi Project 88 may add or remove features from all its content from time to time. Revi Project 88 will use reasonable effort to inform ‘User’ of changes. Revi Project 88 reserves the right to make changes to its content (including EULA and Privacy Policy) without any annoucement to ‘User’ at the time of change.

Revi Project 88 content might influence ‘User’ view about the content investigated. The ‘User’ must understand and be aware that the content is not a source of a final truth and could interfere (positive and negative) with what ‘User’ know about the content investigated. 

Revi Project 88 assume no responsibility for errors, inaccuracies, omissions, or any other inconsistencies; herein and hereby disclaim any liability to any party for any loss, damage, or disruption caused by errors or omissions, whether such errors or omissions result from negligence, accident, or any other cause.

Revi Project 88 confirms that there is no conflict of interest of any kind with the public figures, news agencies, authors of any kind and purpose, or any other entity that are written and part of the content. If there is a conflict of interest, an annoucement will be made inside the content.

Non-fiction content is made based on the best knowledge and understanding of Casian Anton and can use or not use scientific journals and textbooks in order to support new ideas. The use of scientific or non-scientific knowledge will be written inside the content.

Fiction content is for entertainment purposes only and the information provided on it should not be relied upon.

Where necessary, Revi Project 88 will inform ‘User’ inside the content about the nature of the content; also information about the content will be available in the presentation of the content on the website hosts.

IV. ‘USER’ RESPONSIBILITIES

‘User’ is directly responsible when sign in/log in on the website hosts in order to access Revi Project 88 content. The website hosts will ask ‘User’ to provide certain personal information such name, date of birth, place of birth, time of birth, gender, marital status and photo. ‘User’ is soley responsible for creating an account on the website hosts using real identity or an assumed name or someone else’s identity.

Casian Anton is the owner to all the content published/released through Revi Project 88 and all the intellectual property rights of the content, including branding, logo, titles and the underlying technologies. ‘User’ may not make any use of or exploit in any way any Casian Anton’s intellectual property rights.

V. ‘USER’ ACCOUNTS AND ACCOUNT SECURITY

‘User’ will need to use credentials (for example ‘User’ name and password) from a third-party online platform to access some or all of Revi Project 88 content. ‘‘User’ must maintain the security of the third-party account and promptly notify the website hosts if discover or suspect that another ‘User’ accessed personal account without ‘User’ permission. If ‘User’ permit others ‘User’ to use personal account credentials, ‘User’ is responsible for the activities of such ‘User’ that occur in connection with ‘User’ account.

VI. ‘USER’ CONTENT

Revi Project 88 content may allow ‘User’ to create, post, store and share content, including messages, text, software and other materials (collectively, ‘User Content). Revi Project 88 does not claim ownership of ‘User’ uses the content (sending from ‘User’ to another ‘User’ any type of information) when using Revi Project 88 content.

When ‘User’ post or otherwise share parts or whole of Revi Project 88 content, ‘User’ understand that any associated information (such as ‘User’ name, location or profile photo) can be visible to the public or anyone who has access to ‘User’ account and Revi Project 88 is not liable for any losses that might occur for ‘‘User’ while ‘User’ is posting or sharing Revi Project 88 content.

‘User’ acknowledge that some of the content may display advertisements and promotions of Revi Project 88 content, and ‘‘User’ hereby agree that Revi Project 88 may place such advertising and promotions on its content. The manner, mode and extent of such advertising and promotions are subject to change without specific notice to ‘User’.

‘User’ cannot create, post, store or share any of Revi Project 88 content that violates these Terms or for which ‘User’ does not have all the rights necessary to grant Revi Project 88 the license described in these Terms. Although Revi Project 88 has no obligation to screen, edit or monitor its content, Revi Project 88 may ask the website hosts to delete or remove all its content at any time and for any reason without informing ‘‘User’ via personal email address or through its social media pages. ‘‘User’ accepts that Revi Project 88 is not liable for any malfunction, lack of access, missing content after deletion or remove of its content from the website hosts. ‘User’ accepts that Revi Project 88 will not pay any compensation to ‘User’ for the content bought after it was deleted or removed from the website hosts, and ‘User’ still continue to use the content saved on any of ‘User’ devices, or the printed editions.

Revi Project 88 does not offer a backup service (for example cloud service for storage of its content) for its content and ‘User’ agree that it will not rely on Revi Project 88 to offer support or advices about backup or storage options. Revi Project 88 is not liable to ‘User’ for any modification, suspension, or discontinuation of the content, or the loss of any of its content.

VII. LICENSE

Subject to ‘User’ compliance with the Terms, Casian Anton (Revi Project 88) grant ‘User’ the following license: 

VII.i a limited, non-exclusive, revocable, non-sublicensable, non-transferable license, to access, download and open the most current generally available version of its content;

VII.ii if the website hosts have a different type of license for ‘User’, then the website hosts license will apply only on the devices authorised by the website hosts.

VIII. LICENSE RESTRICTIONS

‘User’ agree that will:

• not rent, lease, sub-license, loan or otherwise make available the content in any form, in whole or in part to another ‘User’ based on any form of payments and rewards without prior written consent from Casian Anton (Revi Project 88);

• not copy the content, except as part of the normal use of the content or where it is necessary for the purpose of education;

• not translate, merge, adapt, vary, alter or modify, the whole or any part of the content nor permit the content or any part of it to be combined with, or become incorporated in, any other content, except as necessary to use the content on devices as permitted in these Terms;

• not disassemble, de-compile, reverse engineer or create derivative works based on the whole or any part of the content nor attempt to do any such things;

• comply with all applicable technology control or export laws and regulations that apply to the technology used or supported by the content;

• the printed edition of the content (that was purchased) can be sold and shared at the ‘User’ discretion.

IX. ACCEPTABLE USE OF THE CONTENT

‘User’ must:

• not use the content in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these Terms, or act fraudulently or maliciously;

• not infringe Casian Anton’s (Revi Project 88) intellectual property rights or those of any third party in relation to ‘User’ and digital content, including by the submission of any material (to the extent that such use is not licensed by these Terms);

• not transmit any material that is defamatory, offensive or otherwise objectionable in relation to ‘User’ and content;

• not use the content in a way that could damage, disable, overburden, impair or compromise the content.

X. INDEMNITY AGREEMENT

To the fullest extent permitted by applicable law from England (Hold-Harmless (Indemnity) Agreement), ‘User’ will indemnify, defend, and hold harmless Revi Project 88 content from and against any loss, liability, claim, demand, damages, expenses or costs (“Claims”) arising out of or related to (1) ‘User’ access to or use of Revi Project 88 content; (2) ‘‘User’ digital content and Feedback; (3) ‘User’ violation of these Terms; (4) ‘User’ violation, misappropriation or infringement of any rights of another (including intellectual property rights or privacy rights); or (5) ‘User’ conduct in connection with Revi Project 88 content. ‘User’ agree to promptly notify Revi Project 88 of any third party Claims, cooperate with Revi Project 88 in defending such Claims and pay all fees, costs and expenses associated with defending such Claims (including, but not limited to, attorneys’ fees). ‘User’ also agree that Revi Project 88 will have control of the defence or settlement of any third party Claims. This indemnity is in addition to, and not in lieu of, any other indemnities set forth in a written agreement between ‘User’ and Revi Project 88.

XI. PAYMENT

Revi Project 88 does not process direct payment from ‘User’ and it does not have access to ‘User’ debit card, credit card information or any other ‘User’ sources of payment and personal information attached to ‘User’ sources of payment. Payment transactions are completed through the website hosts technology where Revi Project 88 does not have access and no role to decide how it is done.

XII. REFUND

Revi Project 88 does not process refunds to ‘User’ and it does not have access to ‘User’ debit card, credit card information or any other ‘User’ sources of payment to do so. All refunds transactions are completed through the website hosts technology and personal information collected by the website hosts from ‘User’ where Revi Project 88 does not have access and no role to decide how it is done.

For refund, ‘User’ must notify the website hosts where ‘User’ accessed Revi Project 88 content.

European Union residents normally have a right to cancel their purchase agreements within 14 days of agreeing to them and receive a refund. Please note and acknowledge: if ‘User’ is resident in the European Union and paid for content from a mobile platform owner (Apple, Amazon, Barnes and Noble, Kobo, Google), ‘User’ may not be able to cancel the order or obtain a refund. Please review the mobile platform owner’s terms in this regard before purchase. ‘User’ can find further information on cancelling orders and any associated refunds on the website of the third party re-seller from whom ‘User’ purchased the digital content (Amazon, Apple App Store, Google Play Store, Kobo, Barnes and Noble).

XIII. LIABILITY

Revi Project 88 will not be liable to ‘User’ under any theory of liability—whether based in contract, tort, negligence, strict liability, warranty, or otherwise—for any indirect, consequential, exemplary, incidental, punitive or special damages or lost profits, even if Revi Project 88 have been advised of the possibility of such damages.

The total liability of Revi Project 88, for any claim arising out of or relating to these Terms, regardless of the form of the action, is limited to the amount paid, if any, by ‘User’ to access and use Revi Project 88 content.

The limitations set forth in this section will not limit or exclude liability for the gross negligence, fraud or intentional misconduct of Revi Project 88 for any other matters in which liability cannot be excluded or limited under applicable law. Additionally, some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to ‘User’.

Revi Project 88 does not control, endorse or take responsibility for any of its content or third-party content available on or linked to by its content.

‘User’ access to Revi Project 88 content is at ‘‘User’ sole risk. The digital content provided “as is” and “as available” without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. 

Revi Project 88 does not represent or warrant that its services are accurate, complete, reliable, current or error-free. 

Revi Project 88 attempts to make ‘User’ access to and use of its content safe, it cannot and do not represent or warrant that its services or servers where the content is available are free of viruses or other harmful components. ‘User’ assume the entire risk and responsability as to the quality and performance of the Revi Project 88 content.

Due to the nature of the sensitive research ideas that must be explored in its entirety for which some ‘Users’ might find it inappropriate, not explored enough in depth or exagerrated, not reliable and there is a lack of a clear causal link based on the evidence used and the conclusions reached, Revi Project 88 is not responsible to ‘User’ for foreseeable loss and damage caused by Revi Project 88 content due to revealing the conclusions of the research that might not be preferable or on the ‘User’ side of view and opinion, also that can show and expose the nature of the research where it is impossible or difficult to reach an approved and final truth of the research advanced. 

If Revi Project 88 fail to comply with these Terms, Revi Project 88 is responsible for loss or damage ‘User’ suffered as of result of Revi Project 88 breaking these Terms. The damage consist by providing to ‘User’ a free digital copy (Apple Books, Google Play Books, Smashwords) of the content for which ‘User’ sufered damage and another free digital copy (Apple Books, Google Play Books, Smashwords) of the first newest content published by Revi Project 88.

Revi Project 88 does not exclude or limit in any way its liability to ‘User’ where it would be unlawful to do so. This includes liability for death or personal injury caused by Revi Project 88 negligence or the negligence of agents or subcontractors or for fraud or fraudulent misrepresentation.

Revi Project 88 is not responsible nor will repair the damage or pay ‘User’ compensation for damage of the devices used to access the content. ‘User’ must read and accept terms of the website hosts where the content was accessed and resolve the issues developed during and after accessing Revi Project 88 content. 

Revi Project 88 content is approved by the website hosts only after the digital content is tested by the technology of the website hosts; in the case that the content does not meet the legal and technical requirement of the website hosts, the content is rejected by the website hosts and Revi Project 88 must resend its content in a format that the website hosts technology agree. Revi Project 88 will not be liable for damage which ‘User’ could have avoided by following Revi Project 88 and the website hosts presentation and advice (free of charge) about the content before use, or for damage which was caused by ‘User’ failing to correctly reading the presentation and advice or to follow installation instructions or advices to have in place the minimum requirements (for example system of operation or age) advised by Revi Project 88 (if neccesary) and the website hosts.

Revi Project 88 only supply the content for domestic and private use. If ‘User’ access the content for any commercial, business or re-sale purpose Revi Project 88 will have no liability to ‘User’ for any loss of profit, loss of business, business interruption, loss of business opportunity or legal effects.

If Revi Project 88 content is delayed by an event outside its control, then Revi Project 88 will make an announcement on social media pages or any other source of information available to Revi Project 88 as soon as possible to let ‘User’ know and take steps to minimise the effect of the delay. Revi Project 88 will not be liable for delays caused by the event.

XIV. WEBSITE HOSTS PRIVACY POLICY AND TERMS OF SERVICE ALSO APPLY

The ways in which ‘User’ can use the content may also be controlled by the website hosts (for example Apple, Amazon, Barnes and Noble, Kobo, Google, Gumroad, Smashwords and other website hosts that are not written here); the Terms and Conditions and Policies of the website hosts will apply instead of these Terms; where there are differences between the two and among those Terms and Policies, there are the following arrangements:

Acknowledgement.‘User’ acknowledge that these Terms are concluded solely between ‘User’ and Revi Project 88, and not with the website hosts; Revi Project 88 is solely responsible for the content and the content thereof. ‘User’ further acknowledge that the usage rules for the content are subject to any additional restrictions set forth in the Privacy Policy and Terms of Service of the website hosts as of the date ‘User’ access and use Revi Project 88 content, and in the event of any conflict, the Privacy Policy and Terms of Service of the website hosts shall govern if they are more restrictive. ‘User’ acknowledge and agree that ‘User’ had the opportunity to review the the Privacy Policy and Terms of Service of the website hosts.

Scope of License. ‘User’ and Revi Project 88 acknowledge that the website hosts have no obligation whatsoever to furnish any maintenance and support services with respect to the content.

Warranty. ‘User’ acknowledge that the website hosts are not responsible for any product warranties, whether express or implied by law, with respect to the content. In the event of any failure of the content to conform to any applicable warranty, ‘User’ may notify the website hosts, and the website hosts will refund the purchase price, if any, paid to website hosts for the content accessed by ‘User’; and to the maximum extent permitted by applicable law, the website hosts will have no other warranty obligation whatsoever with respect to the content. ‘User’ and Revi Project 88 acknowledge that to the extent that there are any applicable warranties, any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any such applicable warranty would be the sole responsibility of Revi Project 88. However, ‘User’ understand and agree that in accordance with these Terms, Revi Project 88 has disclaimed all warranties of any kind with respect to the content, and therefore, there are no warranties applicable to the content.

Product Claims. ‘User’ and Revi Project 88 acknowledge that as between the website hosts and Revi Project 88, Revi Project 88, not the website hosts, is responsible for addressing any claims relating to the content or ‘User’ possession and/or use of the content, including, but not limited to (1) product liability claims, (2) any claim that the content fails to conform to any applicable legal or regulatory requirement, and (2) claims arising under consumer protection or similar legislation.

Intellectual Property Rights. ‘User’ and Revi Project 88 acknowledge that, in the event of any third-party claim that the content or ‘User’ possession and use of the content infringe that third party’s intellectual property rights, Revi Project 88, and not the website hosts, will be solely responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim to the extent required under these Terms.

Legal Compliance. ‘User’ represent and warrant that (1) ‘User’ is not located in a country that is subject to a U.K. Government embargo, or that has been designated by the U.K. Government as a “terrorist supporting” country, and (2) ‘User’ is not listed on any U.K. Government list of prohibited or restricted parties.

Third-Party Terms of Agreement. ‘User’ agree to comply with any applicable third-party terms when using Revi Project 88 content.

Third-Party Beneficiary. ‘User’ and Revi Project 88 acknowledge and agree that the website hosts and its subsidiaries, are third-party beneficiaries of these Terms, and that, upon ‘User’ acceptance of these Terms, the website hosts will have the right (and will be deemed to have accepted the right) to enforce these Terms against ‘User’ as a third-party beneficiary thereof.

XV. ‘USER’ PRIVACY

When Revi Project 88 process ‘User’ personal data, it is done in accordance with the Data Protection law (United Kingdom) and General Data Protection Regulation (EU 2018) which apply to Revi Project 88 and with its EULA and Privacy Policy. By using Revi Project 88 content, ‘User’ agree to the processing of information set out in Privacy Policy, so please read it carefully.

XVI. COMPLAINTS AND ALTERNATIVE DISPUTE RESOLUTION

Please read the following section carefully because it requires ‘User’ to arbitrate certain disputes and claims with Revi Project 88 and limits the manner in which ‘User’ can seek relief from Revi Project 88.

Except for small claims disputes in which ‘User’ or Revi Project 88 seek to bring an individual action in small claims court located in the county of ‘User’ billing address or disputes in which ‘User’ or Revi Project 88 seeks injunctive or other equitable relief for the alleged unlawful use of intellectual property, ‘User’ and Revi Project 88 waive ‘User’ rights to a jury trial and to have any dispute arising out of or related to these Terms resolved in court. Instead, all disputes arising out of or relating to these Terms will be resolved through confidential binding arbitration according with the United Kingdom (England) arbitration law and practice in the UK (England).

‘User’ acknowledge and agree that ‘User’ read and understand the rules of arbitration or waive ‘User’ opportunity to research online or public/private library and read the rules and any claim that the rules of arbitration are unfair or should not apply for any reason.

‘User’ and Revi Project 88 agree that any dispute arising out of or related to these Terms is personal to ‘User’ and Revi Project 88 and that any dispute will be resolved solely through individual arbitration and will not be brought as a class arbitration, class action or any other type of representative proceeding.

Any claim arising out of or related to these Terms must be filed within two (2) months after such claim arose; otherwise, the claim is permanently barred, which means that ‘User’ and Revi Project 88 will not have the right to assert the claim.

‘User’ has the right to opt out of binding arbitration within 30 days of the date ‘User’ first accepted these Terms by notifying Revi Project 88 via electronic communication available to ‘User’.

In order to be effective, the opt out notice must include ‘User’ full name and clearly indicate ‘User’ intent to opt out of binding arbitration. By opting out of binding arbitration, ‘User’ agree to resolve Disputes in accordance with United Kingdom law.

These Terms and ‘User’ access to and use of Revi Project 88 digital content will be governed by and construed and enforced in accordance with the laws of United Kingdom (England). Any dispute between the ‘User’ and Revi Project 88 that is not subject to arbitration or cannot be heard in small claims court will be resolved in England and in the court of the city where ‘User’ or Revi Project 88 filed documents for such claims.

All disputes may be solved by contacting Revi Project 88 or for online resolution to the European Commission Online Dispute Resolution platform via https://webgate.ec.europa.eu/odr/main/?event=main.home.show.

XVII. TERMINATION

Revi Project 88 reserve the right, without notice and in sole discretion, to terminate ‘User’ right to access or use Revi Project 88 content. Revi Project 88 is not responsible for any loss or harm related to ‘User’ inability to access, understand, refusal of accepence by ‘User’ of the conclusions reached of the research conducted and use of Revi Project 88 content.

XVIII. OTHER IMPORTANT TERMS

EULA and the documents referred to in them contain the whole of the agreement between ‘User’ and Revi Project 88 relating to the digital content.

No representation or other pre-contractual statement will have any legal effect unless (and solely to the extent that) it is repeated in EULA.

EULA are the terms of a contract whereby we provide ‘User’ with access to Revi Project 88 content in return for a price or free of charge. Nothing in these Terms will create any relationship of partnership, agency or employment between Revi Project 88 and ‘User’.

No waiver of any of these Terms will be valid unless Revi Project 88 agree it in writing.

This EULA and all non-contractual obligations arising out of or in connection with them are governed by England law and subject to the exclusive jurisdiction of the England courts. 

XIX. MISCELLANEOUS

EULA constitute the entire agreement between ‘User’ and Revi Project 88 relating to ‘User’ access to and use of Revi Project 88 content. The failure of Revi Project 88 to exercise or enforce any right or provision of these Terms will not operate as a waiver of such right or provision. The section titles in these Terms are for convenience only and have no legal or contractual effect. Except as otherwise provided herein, these Terms are intended solely for the benefit of the ‘User’ and parties and are not intended to confer third party beneficiary rights upon any other person or entity.

XX. FEEDBACK
